Learn the Salafi (Ahl al-Hadith) position on pronouncing three divorces during menstruation, with evidence from the Qur’an, authentic Hadith, and scholarly explanations.

Three Divorces During Menstruation in Islam According to the Salafi (Ahl al-Hadith) Understanding

The issue of pronouncing three divorces (triple Talaq) during a woman’s menstrual period (Hayd) has long been discussed by Islamic scholars. According to the Salafi (Ahl al-Hadith) understanding, divorce issued during menstruation is considered a bid’ī (innovative or irregular) divorce because it contradicts the method taught by the Qur’an and the Sunnah. Many scholars within this tradition also hold that if a husband pronounces three divorces in one sitting, they count as one revocable divorce, based on evidence from authentic Hadith and the practice during the lifetime of the Prophet ﷺ and the caliphate of Abu Bakr (رضي الله عنه). Other Sunni schools have reached different legal conclusions on this issue.

Divorce Must Be Given According to the Qur’an

Allah says:

“O Prophet, when you divorce women, divorce them for (the commencement of) their waiting period (‘iddah), and keep count of the waiting period…”

Surah At-Talaq (65:1)

According to the Salafi interpretation, this verse indicates that divorce should be pronounced at a time when the waiting period can properly begin—namely, when the wife is not menstruating and has not been approached intimately during that period of purity.

Divorce During Menstruation Is Contrary to the Sunnah

The principal evidence is the narration of Abdullah ibn Umar (رضي الله عنه).

He divorced his wife while she was menstruating. His father, Umar ibn al-Khattab (رضي الله عنه), informed the Prophet ﷺ.

The Prophet ﷺ said:

“Command him to take her back, then let him keep her until she becomes pure, then menstruates again, then becomes pure. After that, if he wishes, he may keep her, or if he wishes, he may divorce her before touching her. That is the waiting period which Allah has commanded for divorcing women.”

Sahih al-Bukhari and Sahih Muslim

This Hadith is regarded as the clearest proof that divorce during menstruation is contrary to the prescribed Sunnah.

Why Is Divorce During Menstruation Prohibited?

According to Salafi scholars, divorcing during menstruation is prohibited because:

  • It contradicts the guidance of the Prophet ﷺ.
  • It prolongs the woman’s waiting period (‘iddah).
  • It may occur during heightened emotion and conflict.
  • It denies the couple an opportunity for reflection and reconciliation before the divorce process proceeds.

For these reasons, it is described as Talaq al-Bid’ah (innovative divorce) in contrast to Talaq al-Sunnah (divorce according to the Sunnah).

What If Three Divorces Are Pronounced During Menstruation?

Many contemporary Salafi and Ahl al-Hadith scholars maintain that:

  • The manner of issuing the divorce is sinful because it opposes the Sunnah.
  • If all three pronouncements are made in one sitting, they count as one revocable divorce, not three.

This position is based primarily on the narration of Ibn Abbas (رضي الله عنه):

During the lifetime of the Messenger of Allah ﷺ, the caliphate of Abu Bakr, and the early years of Umar’s caliphate, a triple divorce pronounced at one time was treated as one divorce. Later, Umar (رضي الله عنه) enforced counting it as three as an administrative measure when people began misusing the ruling.

Sahih Muslim

Scholars who adopt this view argue that the original prophetic ruling should continue to be followed.

Scholarly Perspective

Among scholars commonly associated with this opinion are:

  • Shaykh al-Islam Ibn Taymiyyah
  • Ibn al-Qayyim
  • Shaykh Abdul Aziz ibn Baz
  • Shaykh Muhammad ibn Salih al-Uthaymin
  • Shaykh Muhammad Nasir al-Din al-Albani

These scholars generally held that triple Talaq issued in one sitting counts as one revocable divorce, while recognizing that other Sunni jurists reached different conclusions based on their legal reasoning.

Can the Husband Reconcile?

According to the Salafi position, if the divorce counts as one revocable Talaq, the husband may reconcile with his wife during the waiting period (‘iddah) without a new marriage contract.

If the waiting period ends without reconciliation, the spouses may remarry through a new Nikah contract with the wife’s consent and a new Mahr.

Wisdom Behind the Prophetic Method

The Qur’an and Sunnah establish a structured process for divorce to:

  • Prevent impulsive decisions.
  • Preserve families whenever possible.
  • Allow time for reconciliation.
  • Protect the rights of both spouses.
  • Ensure that the waiting period begins correctly.

These objectives are viewed as being undermined when divorce is pronounced during menstruation or when multiple pronouncements are made at once.

Important Note

The legal effects of divorce can vary depending on the facts of each case and the legal methodology followed by different schools of Islamic jurisprudence. Muslims facing a real divorce situation should consult qualified scholars or a recognized Islamic authority before acting, especially where there are disagreements among jurists.
